This website is operated by Artem Kuts, an individual seller based in Poland, operating under the trading name SAFEVERIS. Throughout this website, the terms “SAFEVERIS”, “we”, “us”, and “our” refer to Artem Kuts operating under the SAFEVERIS brand.

SAFEVERIS offers this website, including all information, content, features, tools, products, and services available through it, to provide customers with an online shopping experience.

By visiting our website, placing an order, purchasing a product, creating an account, or otherwise using any part of the website or our services, you agree to be bound by these Terms of Service (“Terms”), together with any additional policies referenced in these Terms, including our Privacy Policy, Refund Policy, and Shipping Policy.

Please read these Terms carefully before accessing or using our website. If you do not agree with these Terms, you should not access the website, place an order, or use our services.

Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to present and sell our products. Shopify is not the seller of products purchased from SAFEVERIS and is not a party to the sales contract between SAFEVERIS and the customer.

Any new features, products, or tools added to the website will also be subject to these Terms. We may update these Terms from time to time by publishing a revised version on this page.

1. ONLINE STORE TERMS

By agreeing to these Terms, you confirm that you are at least the age of majority in your country or place of residence, or that you are using the website with the permission and supervision of a parent or legal guardian.

You may not use the website or our products for any illegal, fraudulent, or unauthorised purpose. You must comply with all laws and regulations applicable to your use of the website and products.

You must not introduce viruses, malicious code, automated attacks, or any other technology that could damage, disrupt, or interfere with the website, our systems, Shopify, or other users.

A serious breach of these Terms may result in the suspension or termination of your access to the website.

2. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, specifications, images, prices, dimensions, compatibility information, and other details shown on the website are accurate and up to date.

The appearance of a product may vary slightly depending on lighting, photography, production tolerances, and the display settings of your device. Such minor differences do not affect your statutory rights where the product does not conform to the sales contract.

The SAFEVERIS Tracking Card is designed for use with compatible Apple devices and the Apple Find My network. Access to specific functionality may require a compatible device, an Apple Account, supported software, an internet connection, Bluetooth, location services, and acceptance of terms provided by Apple or another relevant third-party service provider.

Third-party platforms, applications, operating systems, and services may be modified, restricted, suspended, or discontinued by their respective providers. We do not control such third-party changes, but this does not limit any statutory rights you may have regarding the conformity of a product purchased from us.

Apple, Apple Find My, iPhone, and other Apple names or marks are trademarks of Apple Inc. SAFEVERIS is an independent brand and is not owned, operated, or endorsed by Apple Inc., except where an official compatibility statement is expressly shown on the product or website.

We reserve the right to modify product descriptions, packaging, availability, or specifications where this does not materially reduce the functionality or quality promised at the time of purchase. Material changes will not apply retroactively to an order without the customer’s agreement.

3. PRODUCT AVAILABILITY

Products may be available exclusively online and may be offered in limited quantities. Availability shown on the website may change without notice.

We reserve the right to limit the quantity of products purchased by one person, household, customer account, payment method, billing address, or shipping address where reasonably necessary to prevent fraud, resale, abuse, or stock shortages.

We may discontinue a product or restrict sales to particular countries or regions. Any offer made through the website is void where prohibited by law.

4. ORDERS AND CONTRACT FORMATION

By submitting an order, you make an offer to purchase the selected product in accordance with these Terms.

After an order is submitted, you should receive an order confirmation by email. This confirmation acknowledges that we have received your order but does not necessarily mean that the order has been accepted.

A sales contract is formed when we accept your order by sending a shipping confirmation, confirming fulfilment, or otherwise expressly confirming that your order has been accepted.

We may refuse or cancel an order before acceptance where reasonably necessary, including where:

• the product is unavailable;
• payment could not be authorised;
• the submitted information is incomplete or inaccurate;
• we identify a pricing or product information error;
• we reasonably suspect fraud, abuse, unauthorised resale, or unlawful activity;
• we cannot deliver the order to the supplied address; or
• accepting the order would violate applicable law.

If payment has already been collected for an order that we cancel, the amount paid will be refunded to the original payment method.

Please review your order, billing information, shipping address, email address, and selected product before completing checkout. Contact us as soon as possible if you notice an error. We cannot guarantee that an order can be changed or cancelled after fulfilment has begun.

5. PRICES, CURRENCIES, TAXES, AND PAYMENT

Product prices are displayed in the currency selected for your market or location. Prices may be changed at any time, but a price change will not affect an order that we have already accepted, except where an obvious pricing error has occurred.

The total amount payable, including applicable product charges, shipping costs, taxes, and any other charges collected by us, will be presented before you submit an order.

Depending on your delivery destination and applicable law, taxes or import charges may be included in the displayed price, collected during checkout, or handled as part of the delivery process. Any charges collected by us will be shown before the order is placed.

You agree to provide current, complete, and accurate billing and payment information. You confirm that you are authorised to use the payment method submitted with the order.

Payments may be processed by Shopify Payments or other third-party payment providers. Your use of a payment method may also be subject to the terms and privacy policies of the relevant payment provider.

6. SHIPPING AND DELIVERY

Shipping destinations, available delivery methods, estimated delivery times, and applicable shipping charges are described during checkout and in our Shipping Policy.

Delivery dates and timeframes are estimates unless we expressly agree to a specific guaranteed delivery date. Delivery may be affected by destination, customs processing, carrier operations, public holidays, weather, demand, incorrect address information, and other circumstances outside our reasonable control.

We will take reasonable steps to process and dispatch accepted orders within the timeframe described on the website or in our Shipping Policy.

You are responsible for providing a complete and accurate delivery address. Please contact us promptly if your address is incorrect. Once an order has been processed or dispatched, we may be unable to change its destination.

Where you are a consumer, responsibility for the product remains with us until you, or a third party designated by you other than the carrier, takes physical possession of it, except where you independently arranged delivery with a carrier not offered by us.

If a shipment appears lost, significantly delayed, or incorrectly delivered, please contact us at support@safeveris.com so that we can investigate the shipment with the fulfilment provider or carrier.

7. RETURNS, WITHDRAWAL, AND REFUNDS

Returns, withdrawal requests, exchanges, damaged items, and refunds are handled in accordance with our Refund Policy.

SAFEVERIS offers a 30-day return period subject to the eligibility requirements and instructions stated in the Refund Policy.

Where you are a consumer located in the European Union or another jurisdiction that provides a statutory right of withdrawal, you may also have the right to withdraw from an eligible distance purchase within 14 days after receiving the product, without providing a reason.

Our voluntary 30-day return policy does not limit or replace any mandatory withdrawal, refund, remedy, or consumer protection rights available under applicable law.

You must contact us before sending a return. Products sent to an address that has not been confirmed by our customer support team may be refused, lost, or significantly delayed.

8. PRODUCT CONFORMITY AND STATUTORY CONSUMER RIGHTS

Products must conform to the sales contract and correspond to the description, quality, functionality, compatibility, and other characteristics reasonably expected under applicable consumer law.

Consumers in the European Union generally benefit from a minimum two-year legal guarantee of conformity beginning on the date the product is delivered. Depending on the circumstances and applicable law, available remedies may include repair, replacement, a price reduction, or termination of the sales contract and a refund.

Any voluntary return policy, manufacturer warranty, commercial guarantee, or promotional promise offered by us is additional to, and does not replace, your mandatory statutory rights.

To report a defective, damaged, incorrect, or non-conforming product, contact support@safeveris.com and include your order number, a description of the issue, and appropriate photographs or videos where reasonably possible.

Nothing in these Terms excludes, restricts, or limits any consumer right or remedy that cannot lawfully be excluded, restricted, or limited.

9. CUSTOMER ACCOUNTS

Certain website features may allow you to create a customer account. You are responsible for keeping your account credentials secure and for activity performed through your account.

You must provide accurate information and promptly update it where necessary. You must notify us if you believe that your account has been accessed or used without authorisation.

We may suspend or close an account where we reasonably believe it is being used fraudulently, unlawfully, or in violation of these Terms.

Third-party trademarks, product names, platform names, and logos remain the property of their respective owners.

We are not responsible for losses that were not reasonably foreseeable when the sales contract was formed, losses caused by information or instructions supplied incorrectly by you, or losses resulting solely from events outside our reasonable control, except where applicable law provides otherwise.

Products sold through the website are intended primarily for personal consumer use. To the maximum extent permitted by law, we are not responsible for business losses, lost profits, lost revenue, lost business opportunities, or business interruption arising from consumer use of the website or products.

19. EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, war, civil unrest, government measures, transport disruption, customs delays, labour disputes, public health emergencies, internet failures, or widespread failures of carriers or service providers.

We will take reasonable steps to minimise the effect of such events and resume performance. This section does not remove any right to cancel or obtain another remedy where such a right is provided by applicable consumer law.

You may stop using the website at any time. We may suspend or terminate your access where reasonably necessary because of unlawful conduct, fraud, security risks, or a material breach of these Terms.

Termination does not affect rights and obligations arising before termination, including payment obligations, accepted orders, returns, refunds, intellectual property rights, and provisions intended to continue after termination.

Nothing in these Terms limits representations, product information, or mandatory pre-contract information that forms part of a consumer sales contract under applicable law.

23. GOVERNING LAW AND CONSUMER PROTECTION

These Terms and contracts concluded through the website are governed by the laws of Poland, without regard to conflict-of-law rules.

If you are a consumer, this choice of law does not deprive you of mandatory consumer protections available under the laws of the country in which you habitually reside, where those protections apply.

Any dispute will be handled by the courts or dispute resolution bodies having jurisdiction under applicable law. Nothing in these Terms restricts a consumer from bringing a claim before a court that has jurisdiction under mandatory consumer protection rules.

Your continued use of the website after updated Terms are published constitutes acceptance of the revised Terms for future use of the website.
